JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-06-2016 Heard learned counsel for the petitioner and learned counsel appearing for the State.

Petitioner apprehends his arrest in connection with Daraunda P.S. Case No. 23 of 2016, registered for the offences punishable under Sections 342 and 353/34 of the Indian Penal Code.

The present case has been lodged on the basis of written report given by the Chawkidar, who stated that while he along with other police officials, including Dy. S.P and officer-incharge, were making investigation in the house of one Harendra Singh, petitioner along with one co-accused Babloo Singh locked the main door from outside and accordingly, they created hurdles in fair investigation.

No.24891 of 2016 (2) dt.16-06-2016 2/2 Learned counsel for the petitioner submits that as a matter of fact, the petitioner is a co-villager of Harendra Singh and he raised voice against atrocities of local police and that is the reason, the officer-in-charge of the concerned police station managed the concerned Chawkidar and got instituted the present false case against the petitioner. It is further submitted that petitioner has no criminal antecedent which is evident from paragraph 3 of the petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VIII, Siwan in Daraunda P.S. Case No. 23 of 2016, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
