The petitioner seeks bail in connection with Ziradei P.S. Case No. 40 of 2018 registered for the offence punishable under Sections 272, 273 and 308 of the Indian Penal Code and Sections 30 and 38 of Bihar Prohibition and Excise Act, 2016. 4.780 lts. of foreign liquor is said to have been recovered from the house of the petitioner and he was apprehended.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has no concern with the seized liquor. He has been falsely implicated in this at the
Patna High Court Cr.Misc. No.46358 of 2018(2) dt.31-07-2018 2/2 instance of his pattidar, namely, Ram Dalan Ram by planting the aforesaid recovery from his house due to animosity. Though four more criminal cases have been lodged against the petitioner, but he is on bail in the said cases. He has been languishing in custody since 12.06.2018.
In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Siwan in connection with Ziradei P.S.
