2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act.

3. As per prosecution case, 82.740 litres illicit Nepali liquor was recovered from the house of Nand Lal Sah, and petitioner is care take of the house.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner has falsely been implicated in this case merely because he happens to be the care taker of the house from where the recovery has been made. Nothing has been recovered from the conscious possession of this petitioner.

5. On the other hand, learned A.P.P. for the State has

No.51405 of 2025(2) dt.31-07-2025 2/2 vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that huge quantity of liquor was recovered from the house of which this petitioner is care taker. Petitioner has got one criminal antecedent of similar nature.

6. Considering the nature of accusation, recovery of huge quantity of illicit liquor and criminal antecedent of the petitioner, the prayer for grant of anticipatory bail to the petitioner is rejected.
