Petitioners seek bail in Bakhtiyarpur P.S. Case No.147 of 2019 (Spl. Case No.4680 of 2019) instituted for the offence under Sections 328, 120-B Indian Penal Code and Sections 30(a), 30(d) of Bihar Prohibition and Excise Act, 2016. Counsel for the petitioners submits that there is no recovery of illicit liquor from possession of the petitioners. The seizure list does not bear signature of the petitioners. As per seizure list, recovery has been made from the hut of Rama Ray and Rajesh Ray.

Petitioners are in custody since 28.05.2019 having

In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Court, Patna, in connection with Bakhtiyarpur P.S. Case No.147 of 2019 (Spl. Case No.4680 of 2019), subject to the condition that both the bailors shall be close relative of the petitioners.
