JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 17-09-2018 Having heard learned Counsel appearing on behalf of the respective parties and considering the counter filed on behalf of the respondent State, affirmed by Additional District Land Acquisition Officer, Patna, more particularly Paragraph Nos. 11 and 12, it appears that the concerned respondents and the authorities are marking the boundary of existing Railway land and for fixation of the pillars for demarcation of the Railway boundary

Patna High Court CWJC No.5373 of 2017 dt.17-09-2018 2/2 viz. the acquired land i.e. land bearing Khata No. 167, Plot No. 90, area 0.02 acre which has been acquired in the year 2003 and for which even the compensation has been paid. It is further stated that no private land is going to be interfered from the said marking of the existing Railway land.

Under the circumstances, when the respondents are marking the boundary of the existing Railway land viz. the acquired land i.e. land bearing Khata No. 167, Plot No. 90, area 0.02 acre, the land which is already acquired in the year 2003 and for which even the compensation has been paid and it is specifically stated that no private land is going to be interfered from the said marking of the existing Railway land, we dispose of the petition.
