The petitioner seeks bail in a case registered for the offences under Section s 25(1-b)a/26(1) of Arms Act. The learned counsel for the petitioner submits that the petitioner is in custody since 13.07.2021, he is a person with clean antecedent, charge-sheet has been submitted and allegation is of recovery of two country-made pistol along with seven semi build pistol from the petitioner.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and nothing was recovered from his possession, it is further submitted that even assuming what has been alleged is true

Patna High Court CR. MISC. No.61857 of 2021(2) dt.23-03-2022 2/2 without admitting then the case under Arms Act and the petitioner has remained in custody for nearly eight months. The learned A.P.P. vehemently opposes the bail application.

Considering the fact that the petitioner is in custody since 13.07.2021, he is a person with clean antecedent, chargesheet has been submitted, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Khagaria (Muffasil) P.S. Case No. 542 of 2021, with a condition that one of the bailor shall be the father (Prakash Mandal) of the petitioner.

The application stands allowed.
