Petitioner seeks bail in a case registered for the offence punishable under Sections 419, 420 and 468 of the Indian Penal Code, Section 30(a) of the Bihar Prohibition and Excise Act, 2016, Section 36 of the Copy Right Act and Sections 103/104 of the Trade Mark Act.

Three bags containing wrappers of different medicine and foreign liquor are said to have been recovered from the trolley of the petitioner and the petitioner was apprehended. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has no concern

Patna High Court Cr.Misc. No.44775 of 2018 (2) dt.25-07-2018 2/2 with the seized article. He happens to be trolley puller and was carrying the aforesaid bags at a paltry freight of Rs.300/- without knowing the contents of the bags. As there is no recovery of any liquor, hence provision of Section 30 of the Bihar Prohibition and Excise Act is not applicable in this case. He has been falsely implicated in the case. He has no criminal antecedent. He has been languishing in custody since 26.12.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Special Case No. 9571 of 2017 arising out of Agamkuan P.S.
