The petitioner apprehends his arrest in connection with Special Case No. 3596 of 2021 arising out of Malsalami P.S. Case No. 220 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise Act.
Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Only on the confessional statement of the co-accused, the name of the petitioner has been transpired in the instant case. Further he submits that in the first information report, it is specifically mentioned that the petitioner is not the owner of the alleged vehicle, rather the same belongs to one wife of Anil Rai. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Special Judge, Excise Act, Patna in connection with Special Case No. 3596 of 2021 arising out of Malsalami P.S.
