2. The petitioners who apprehend arrest in connection with Darauli P.S. Case No. 141 of 2026 lodged on 18.03.2026, for the offences punishable under sections 126(2), 109, 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution, the F.I.R. has been lodged against eight named accused persons, including the present petitioners. It is alleged that the informant is a private Amin who measures land on request. It is further alleged that, at the request of one Anil Kumar Kharwar, the informant had earlier measured his land, which displeased the opposing party. Thereafter, the

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. It is contended that the informant, being a private Amin, used to carry out incorrect and unauthorized measurements. It is further submitted that despite the presence of the Government Amin, the informant unlawfully interfered with the measurement of the land, which led to a heated exchange between the parties. During the ensuing scuffle, the informant allegedly sustained injuries.

5. Learned counsel further submits that the informant, in connivance with land grabbers, had been acting as a private Amin for illegal purposes. It is also submitted that, with respect to the same date, time, and place of occurrence, there is a case and counter-case pending between the parties. It is further argued that although the F.I.R. alleges that the informant was assaulted on the head, the injury report records an injury on the nose, which does not corroborate the allegations made in the F.I.R.

6. Learned A.P.P. for the State opposes the prayer for bail. However, he fairly submits that the informant is a private

7. In the facts and circumstances of the case, let the above-named petitioners be released on bail, in the event of their arrest or surrender before the Trial Court within a period of four weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand only) each, as mentioned in Section 2(1)(d) of the Bharatiya Nagrik Suraksha Sanhita, 2023, to the satisfaction of the learned Court Judicial Magistrate, First Class, Siwan, in connection with the aforementioned case, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023.
