The petitioners seek bail in connection with Goreakothi P.S. Case no. 105 of 2018 registered under Sections 30(a) and 41(i) of Bihar Excise and Prohibition Act-2016. 129.6 lts. of foreign liquor is said to have been recovered from Bolero vehicle and petitioners were apprehended in the course of escaping from the said vehicle while five other accused persons managed to escape. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioners. They have no concern

They have been falsely implicated in this case by the police merely on suspicion while they were passing through the place of occurrence at the time of occurrence and real culprits managed to escape leaving the aforesaid liquor laden vehicle there seeing the police party. Petitioners have no criminal antecedent. They have been languishing in custody since 7.06.2018.
In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-II-cum-Special Judge Excise, Siwan in connection with Goreakothi P.S. Case no. 105 of 2018 (Prakash Chandra Jaiswal, J) rohit/- U T
