The petitioner seeks regular bail in connection with Forbisganj P.S. Case No.350 of 2018 registered for the offences punishable under Sections 21(b)/22 of the N.D.P.S. Act. The informant who happens to be an A.S.I. of Forbisganj Police Station apprehended this petitioner and two others from a tempo vehicle from which 500 bottles of cough syrup have been recovered as per seizure list. It has been submitted that the petitioner is aged about 22 years and is a student. He had no concern or any knowledge about the seized cough syrup. The petitioner was arrested in a tempo vehicle while he was travelling as passenger and nothing

Patna High Court Cr.Misc. No.38272 of 2018 (3) dt.23-07-2018 has been recovered from his possession. He is in custody since 18.05.2018 having clean antecedent and so he deserves bail. The learned A.P.P. for the State opposed the submission.

Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of the learned Sessions Judge, Araria in connection with Forbisganj P.S. Case No.350 of 2018 corresponding to Spl. Case No.09 of 2018.
