This application for regular bail arises out of Malsalami P.S. Case No. 43 of 2018, disclosing the offence under Section 302 and other allied Sections of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner is in possession of the case diary.

In response to a query made by this Court, he has submitted that the case diary was obtained earlier for conducting anticipatory bail of some of the accused persons and this is how a copy of the case diary has reached him. It is not his stand that the police documents have been made available to him by the

Patna High Court CR. MISC. No.48647 of 2019(4) dt.04-12-2019 2/2 court below after submission of charge-sheet. It is evident, thus, that the case diary has been obtained illegally either by influencing the Investigating Agency or some other office. This is clear indication that the petitioner may tamper with the investigation, if he is allowed regular bail. Further, considering the seriousness of the offence also, I am not inclined to grant the petitioner privilege of regular bail.

This application is accordingly rejected.
