The petitioners seek bail in Pakri Barawan P.S. Case No. 138 of 2019, instituted for the offence under Section(s) 341, 323, 324, 325 and 307/34 of the Indian Penal Subsequently, Section 302 of the Indian Penal Code and Section 27 of the Arms Act was added.

In the written report there is specific allegation against co-accused Ram Kishun Chauhan of making firing which hit on the head of Shobha Devi, who subsequently died. There is general and omnibus allegation against the petitioners. Counsel for the petitioners submits that co-accused

Patna High Court CR. MISC. No.52399 of 2019(2) dt.27-08-2019 2/2 Pradeep Chauhan has already been granted bail by this Court vide order dated 8.8.2019 passed in Cr. Misc. 48199 of 2019. Petitioners are in custody since 5.5.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawadah, in connection with Pakri Barawan P.S. Case No. 138 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioners.
