The petitioners seek bail in anticipation of their arrest in connection with Karai Parsurai P.S. Case No. 62 of 2019 dated 24.04.2019 instituted for the offences under Sections 379 and 414 of the Indian Penal Code. The accusation against the petitioners is of making attempt to take away an engine of the vehicle. On inquiry, it was learnt that the engine of the vehicle

Patna High Court CR. MISC. No.47779 of 2019(3) dt.16-11-2019 2/2 was stolen property. The local villagers are said to have informed the police that the petitioners are involved in this kind of occurrence. The petitioners have earlier also been made accused in the case of similar nature. Considering the aforestated facts, I am not inclined to grant anticipatory bail to the petitioners. Prayer for bail is rejected.

However, if the petitioners surrender before the court below and seek bail, the court below shall take into account all necessary facts and shall pass orders in accordance with law without being prejudiced by the fact that the present petition has not been entertained.
