The petitioner apprehends his arrest in Mahnar P.S. Case No. 62/2013 registered under Sections 365, 363 and other sections of the Indian Penal Code.
The informant Binod Das filed a complaint case, on the basis of which, the present F.I.R. was lodged. The informant made allegation against Rajnish Prasad and Geeta Devi that they along with the petitioner kidnapped his wife along with minor children.
Learned counsel for the petitioner submits that Yugal Kishore Prasad, father of Rajnish Prasad, also filed Mahnar P.S. Case No. 61/13 for kidnapping of his son Rajnish Prasad. The petitioner is not at all related with Rajnish Prasad. The victim made her statement under Section 164 Cr.P.C. after nine months
Patna High Court Cr.Misc. No.4260 of 2015 (2) dt.02-02-2015 2/3 of the occurrence. She alleged that the petitioner along with other accused persons forcibly made her to sit in a Bolero and Rajnish Prasad kidnapped her. Rajnish Prasad also committed rape with her.
Learned counsel for the petitioner submits that the co-accused Hari Kishore has been granted anticipatory bail by the learned Sessions Judge. The case of the petitioner stands on the same footing. Co-accused Geeta Devi has also been granted anticipatory bail by this Court.
Having considered the facts that the only allegation against the petitioner is that he along with other accused persons forcibly made the wife of the informant to sit in a Bolero and on the similar fact Geeta Devi has been granted anticipatory bail and Hari Kishore has been granted anticipatory bail by the learned Sessions Judge and the case of the petitioner stands on the same footing, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in Mahnar P.S. Case No. 62/2013, subject to
