JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 307, 427, 447 and 379 of the Indian Penal Code and Section 27 of the Arms Act.
It is alleged that the petitioners along with unknown persons came variously armed, cut the wheat crop from one bihga land of the informant and resorted to firing but no injury was caused to anyone.
It is submitted by learned counsel for the petitioners that the land in question is recorded in the name of the ancestor of the petitioners in the revenue records and admittedly no injury was caused to anyone. A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.3057 of 2015 (2) dt.22-01-2015 2/2 petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bettiah, West Champaran in connection with Sathi P.S. Case No. 77 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
