2. The petitioner apprehends his arrest in a case registered for the offence under Sections 272/273/34 of the IPC and Section 30(a) of Bihar Prohibition and Excise Act.

3. As per F.I.R., 52 liters of country-made liquor was recovered from the seized vehicle and petitioner is alleged to have fled away from the spot.

4. Learned counsel for the petitioner submits that no incriminating article has been recovered from the conscious possession of petitioner and has been implicated in this case only on suspicion. Petitioner is neither owner nor driver of the seized vehicle.

5. Learned A.P.P. for the State has opposed the bail petition and has submitted that petitioner has got four criminal

6. Considering the quantity of recovery and also the criminal antecedent of this petitioner, I am not inclined to grant him bail. It is accordingly rejected.
