The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 323, 353 and other allied sections of the Indian Penal Code and sections 25(1-B)a, 26/35 of the Arms Act.

As per the prosecution case, on secret information of firing and scuffle between two groups, informant reached at the place of occurrence. It is further alleged that the accused persons attacked upon the informant and other police officials. Some of the accused persons apprehended by the police who

It is submitted that there is no specific allegation of overt act against petitioners rather allegation of assault is general and omnibus. Similarly situated co-accused have been granted bail by this different Benches of this court vide Annexure-2. Petitioners claim clean antecedents. Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Nawada in connection with Nardiganj P.S. Case No. 93 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
