JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 04-12-2015 After having heard learned senior counsel for the petitioner and counsel for the private respondent as well as the State, matter is remanded back to the Commissioner, Saran Division, Chapra, on the sole ground to verify what has been categorically stated in para 13 of the writ application.
The petitioner is duty bound to produce the entire writ application before the Commissioner and highlight para 13 and the position indicated therein will be verified from the official records and files, which are readily available in the office and thereafter, if the
Patna High Court CWJC No.9200 of 2014 dt.04-12-2015 matter requires to be heard, he may do so and pass order if the facts do not reflect what has been asserted in para 13. This Court does not express any opinion on the merit of the adjudication.
