JUSTICE BIRENDRA KUMAR ORAL ORDER 24-07-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 406/420 of the Indian Penal Code.

Allegation is that on inducement of this petitioner, the informant invested money for business purpose. The total investment is of Rs.10,00000/- (Ten lacs) out of which Rs.4,36,000/- (Four lacs thirty-six thousands) was paid through cheque.

Learned counsel for the petitioner submits that only cheque was received by the petitioner and petitioner undertakes to refund the same within three months in monthly

Considering the aforesaid undertaking of the petitioner, let the petitioner, above named, be released on provisional bail for three months from the date of filing of the bail-bonds on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Kataiya P.S. Case No.284 of 2017. In the meantime, the petitioner shall deposit bank draft of the refund money in the name of the informant before the learned Court-below and after ensuring realization of the aforesaid amount of Rs.4,36,000/- within the aforesaid period of three months, the learned Court-below shall confirm the bail-bond of the petitioner, failing which the learned Court-below shall have liberty to cancel the bail-bond of the petitioner.
