====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 06-12-2024 Heard Mr. Aryan Singh, learned counsel appearing on behalf of the petitioner and Mr. Rabindra Kumar, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Samastipur (Muffasil) P.S. Case No. 638 of 2022 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 326,109 of the Indian Penal Code and Section 27 of the Arms Act.

3. Petitioner had filed Cr. Misc. No. 71458 of 2023 seeking bail in connection with Samastipur (Muffasil) P.S. Case No. 638 of 2022. The said bail application was heard on 07.11.2023, by which, the petitioner was allowed pre-arrest bail.

No.60467 of 2024(3) dt.06-12-2024 2/2 The petitioner has filed the present anticipatory bail application second time in view of the fact that the bail bond of the petitioner was not accepted as it was found that the statement made in paragraph no. 3 of Cr. Misc. No. 71458 of 2023, with respect to criminal antecedent, was found incorrect. The petitioner had renewed his pre-arrest bail before the learned District Court, which was rejected vide order dated 24.05.2024.

4. Considering the information contained in paragraph no. 3 of the present bail application to be correct, I am inclined to enlarge the petitioner on pre-arrest bail on similar terms and conditions as contained in order dated 07.11.2023 passed in Cr. Misc. No. 71458 of 2023.

5. Accordingly, the present bail application stands disposed of.
