JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2019 Petitioner prays for bail in connection with Sessions Trial No.456A of 2011, arising out of Lauriya Police Station Case No.122 of 2001 registered for the offence punishable under Section 364 of the Indian Penal Code. Allegation against the petitioner is of kidnapping and it further appears that the petitioner was absconding in this case for a long time and other accused persons have been acquitted on trial.

Earlier prayer of the petitioner was rejected by order dated 26.11.2018.

Submission of learned counsel for the petitioner is that petitioner is in custody for more than a year and now charge has also been framed.

No. 53887 of 2019(3) dt.11-09-2019 2/2 In view of the facts as stated above, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge- 5th , Bettiah, West Champaran in connection with Lauriya Police Station Case No.122 of 2001, subject to condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with further condition that petitioner will co-operate in disposal of the trial and make himself available as and when required by the court below, failing which, his bail bonds shall be cancelled.
