2. The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

3. As per F.I.R., 44 liters of illicit liquor was recovered from motorcycle.

4. Learned counsel for the petitioner submits that no incriminating article has been recovered from the conscious possession of petitioner. Petitioner is neither owner nor driver of the seized vehicle. Name of the petitioner transpired during the course of investigation.

5. Learned A.P.P. for the State has opposed the bail petition and has submitted that the petitioner has got two criminal antecedents of similar nature.

6. Considering the criminal antecedent of the petitioner, his prayer for grant of anticipatory bail is rejected. It is accordingly dismissed.
