The petitioner is apprehending their arrest in a case under Section 498A and other sections of the Indian Penal Code. The complainant made allegations of demand of dowry and torture against the petitioner, who is her husband. Learned counsel for the petitioner submits that the present complaint petition was filed on 25.10.2013. The petitioner filed Matrimonial Case No. 156/2013 on 23.10.2013. Learned counsel appearing for the complainantopposite party no. 2 submits that the complainant is ready to live
Patna High Court Cr.Misc. No.2476 of 2015 (2) dt.20-01-2015 2/2 with her husband. She has also got a child.
It appears that there is a matrimonial dispute between the husband and the wife and after filing of the divorce case by the husband, the complaint petition was filed by the complainant. Having considered the facts aforesaid, let the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Pupri, Sitamarhi in Complaint Case No. C-1/468 of 2013, corresponding to Tr. No. 1205/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
