It has been submitted that petitioner has been granted anticipatory bail on 21.08.2018, but petitioner was already arrested before passing of order. The counsel had no knowledge of arrest of petitioner.

This Court finds gross negligence on the part of the counsel for petitioner.

The order dated 21.08.2018 granting anticipatory bail to the petitioner in Rajoun P.S. Case No.17 of 2018 to the satisfaction of the Chief Judicial Magistrate, Banka, is hereby recalled.

Counsel for the petitioner is warned to be careful in

Patna High Court Cr.Misc. No.46474 of 2018 (3) dt.27-08-2018 2/2 future. If such thing is repeated in future, this Court will take serious view of the matter.

Counsel for the petitioner is directed to deposit rupees five thousand as cost with Patna High Court Legal Aid Committee within a period of four weeks from date of passing of this order for such gross negligence.
