The petitioner apprehends his arrest in a case registered under Sections 409/34 of the Indian Penal Code. It appears that the prayer for anticipatory bail of the petitioner was earlier rejected on 28.04.2003 vide Cr. Misc. No. 6201 of 2003, but the petitioner did not surrender in the court below thereafter and he has evaded his appearance for the last 12 years. On this ground alone, I am not inclined to grant anticipatory bail to the petitioner in Mahua P.S. Case No. 182 of 2000, pending in the court of the learned Chief Judicial Magistrate, Vaishali at Hajipur.

Accordingly, the prayer for anticipatory bail is rejected.
