The petitioner is languishing in custody for the offences punishable under Sections 365/364 of the Indian Penal Code.
According to FIR, the informant's brother went for Bettiah. However, he did not return. After lodging of the FIR his dead body was recovered. The FIR is against unknown. Submission is that Chandan Kumar with whom the deceased had some dispute relating to transfer of land as the deceased was a middleman in the deal of land. Therefore, Chandan Kumar and others conspired to eliminate the deceased. Chandan Kumar has already been granted bail by a coordinate
Patna High Court Cr.Misc. No.46814 of 2018 (2) dt.09-08-2018 P2/ Bench of this Court in Cr. Misc. No.31177 of 2018. His contention is that during investigation it revealed that from the mobile of this petitioner the deceased was in talking term. The said mobile number was being used by Anjali Singh, the wife of this petitioner; whereas Anjali Singh is wife of one Bharat Raut. Therefore, besides suspicion there is no substantial material against the petitioner.
Learned counsel for the informant opposed the prayer for bail.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Nagar Bettiah P.S. Case No.866 of 2017, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
