====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 25-09-2024 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in connection with Complaint Case No.1268 of 2015 instituted under Sections 354, 354(A), 354(B), 354(D), 323 and 341 of the Indian Penal Code.
3. As per the complaint case, when the complainant was coming back from the school, in the meantime petitioners teased her and tried to outrage her modesty and also assaulted the victim. It is also alleged that the petitioners used to tease the
Patna High Court CR. MISC. No.55628 of 2024(3) dt.25-09-2024 2/3 victim since last one month.
4. Learned counsel for the petitioners submits that petitioners are innocent and have been falsely implicated in this case. He further submits that one week earlier the mother of petitioner no.2 had lodged an F.I.R. against the father of the victim/complainant and to save himself, the present complaint has been filed against the petitioners leveling false allegation. Learned counsel submits that the allegations against the petitioners are general in nature and the complaint has been filed after delay of 14 days of alleged occurrence. He further submits that the petitioners have no criminal antecedent and they undertakes to cooperate in the investigation.
5. Learned A.P.P. for the State opposes the prayer for anticipatory Bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount to each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Complaint Case No.1268 of 2015, subject to the conditions laid
