JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-08-2019 The present petition has been filed for modifying the order dated 23.07.2018 passed in Criminal Misc. No. 30775 of 2018 to the extent that the amount undertaken to be deposited by the petitioner i.e. a sum of Rs. 50,000/- be reduced. The learned counsel for the petitioner submits that even after lot of efforts, the family members of the petitioner have not been able to arrange the aforesaid sum of Rs. 50,000/-, required to be deposited before the concerned court on account of financial problems, hence a liberal view may be taken and the amount be reduced to a sum of Rs. 25,000/-.
Having regard to the facts and circumstances of the case and considering the submissions made in the present
Patna High Court CR. MISC. No.50573 of 2019(2) dt.28-08-2019 2/2 petition as also orally by the learned counsel for the petitioner, the order dated 23.07.2018 passed in Criminal Misc. No. 30775 of 2018 stands modified to the extent that the petitioner is now required to deposit a sum of Rs. 25,000/- before the Nazarat of the learned Civil Court, Bhojpur at Ara in connection with Sessions Trial No. 408 of 2017 arising out of Charpokhari P.S. Case No. 245 of 2016.
The rest of the conditions as stated in the order dated 23.07.2018 passed in Criminal Misc. No. 30775 of 2018, shall remain same.
With the aforesaid modification in the order dated 23.07.2018 passed by this Court in Criminal Misc. No. 30775 of 2018, the present petition stands disposed off. (Mohit Kumar Shah, J) S.Sb/- U T
