JUSTICE SANJAY PRIYA ORAL ORDER 2/ 24-07-2019 This application has been filed for modification of the order dated 21.06.2018 passed in Cr. Misc. No.903 of 2018 by which petitioner has been granted anticipatory bail in connection with Complaint Case No.748 of 2017 to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur.

It has been submitted that the petitioner is facing difficulty in complying condition No.2 of the aforesaid bail order since the petitioner is working as Inspector of Central Excise in the office of Chief Commissioner of Central Excise, Chennai Zone.

In view of such, Condition No.2 of the aforesaid bail

Patna High Court CR. MISC. No.45868 of 2019(2) dt.24-07-2019 2/2 order is modified to the extent that petitioner will file petition under Section 317 Cr.P.C. on the date(s) fixed, which shall be considered and disposed off by the Court below in accordance with law. The Petitioner will remain physically present as and when directed by the Court below.

This Modification Application is, accordingly, allowed.
