The petitioners apprehend their arrest in Gayghat P.S. Case No. 327/2014 registered under Sections 341, 353, 323, 504, 506/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the occurrence took place at the time of PACCS Election. The petitioners were only encouraging the voters to cast their votes. The allegation of putting hindrance in the smooth polling is absolutely false.
Considering the facts aforesaid and the nature of allegation made against the petitioners that the petitioners put
Patna High Court Cr.Misc. No.4880 of 2015 (2) dt.04-02-2015 2/2 some hindrance but no force was used, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri A.K. Dixit, Judicial Magistrate 1st Class, Muzaffarpur in Gayghat P.S. Case No. 327/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
