The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420, 467 and 468/34 of the Indian Penal Code. It is alleged that the informant purchased a land through Sanjay Lohani, this petitioner and Ashok Yadav. Subsequently the informant came to know that the sale deed was executed by a fictitious lady then Sanjay Lohani issued a cheque for Rs.23,00,000/- in favour of nephew of the informant. It is submitted by learned counsel for the petitioner that the petitioner is neither a witness on the agreement to sell and in the actual sale deed nor it is alleged that
Patna High Court Cr.Misc. No.3909 of 2015 (02) dt.29-01-2015 2/2 he executed the sale deed.
A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Gaya Kotwali P.S. Case No. 275 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
