Petitioner is in custody in connection with Lakhisarai P.S. case No. 38 of 2018 for the offence under sections 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent and from perusal of Fard-beyan it would be evident that there is no overt act alleged against this petitioner. The allegation against this petitioner is similar to that of Kunal Yadav who has been granted bail by a coordinate Bench of this court in Cr. Misc. No. 31704 of 2018 vide order dated 7.6.2018.
