1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in connection with Bahera P.S. Case No. 468 of 2023 registered for the offence punishable under Sections 302, 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is accused of killing the deceased.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is in custody since 20.05.2024. Initially, the FIR was registered under Section 302 of the IPC but the chargesheet has been submitted under Section 306 of the IPC.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Benipur at Darbhanga in connection with Bahera P.S. Case No. 468 of 2023.
