Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defect(s) as pointed out by the office when called upon to do so by the office. The petitioner is apprehending his arrest in a case in connection with Sonepur (Hariharnath O.P.) P.S. Case No. 308 of 2020 pending in the Court of learned CJM, Saran registered for the offences punishable Sections 304(B) and 201/34 of the Indian Penal Code.
It is a case of dowry death, namely, Moni Devi due to non-fulfilment of dowry demand.
It is submitted by learned counsel for the petitioner
Patna High Court CR. MISC. No.7984 of 2021(3) dt.07-02-2022 2/2 that the petitioner has falsely been implicated in this case. He further submits that the petitioner is the husband of the deceased. He further submits that petitioner has got clean antecedent.
Learned APP appearing for the State has opposed the prayer for anticipatory bail.
From perusal of the FIR as well as case diary, it appears that the prosecution witnesses have supported the case of the prosecution and the petitioner is the husband of the deceased and who is full responsible to maintain his wife properly, as such, I am not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail is rejected.
