Learned counsel for the petitioner undertakes to remove the defects as pointed out by the office within three weeks of normal functioning of the court, failing which the office is directed to place the matter before the Bench. The petitioner seeks bail in a case registered for the offence punishable under Sections 302, 201,120B/34 of the Indian Penal Code.

The prosecution case in brief is that as per written report given by the informant, it is alleged that her father-in-law went for money before one Heera Lal Das on 13.11.2019 and did not return till evening. It is further alleged that she went to Raghopur to look for her father-in-law and returned to the place of Heera Lal Das, but she did not get any information. It is further alleged by the informant that on 20.11.2019, she received information that the dead body had been recovered

Patna High Court CR. MISC. No.8537 of 2021(2) dt.01-02-2021 2/2 beside the river at Laxmipur, Dumrhi. Based on the above-said, the present FIR was lodged and the petitioner was arrested thereupon.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is no specific allegation against the petitioner. There is general and omnibus allegation against the petitioner. The petitioner is in custody since 26.11.2019 and has got no criminal antecedent. He further submits that vide order dated 03.06.2020, a liberty was granted to the petitioner to renew his prayer for bail after framing of charge. He further submits that charge has been framed against the petitioner vide order dated 06.11.2020. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-V, Supaul, in connection with S.Tr. No. 136/2020 arising out of Chhatapur P.S. Case No. 291 of 2019.
