The petitioner is apprehending his arrest in a case registered under sections 305/506 of the Indian Penal Code and under section 3(i)(x) of S.C/S.T. Act.

The In-charge Headmaster made allegation that the petitioner came inside the school and abused Kanchan Kumari a teacher who belongs to Scheduled Caste. Learned counsel for the petitioner submits that the occurrence took place on 06.06.2013 but the first information report was lodged on 17.06.2013 that is after eleven days of the occurrence. The teacher did not make any complain about abusing her. Petitioner was summoned and the police let him off under section 41 Cr.P.C.

No.3521 of 2015 (2) dt.27-01-2015 2/2 Having considered the fact that there is very specific allegation that the petitioner enterned into the school and abused the teacher, I do not find it a fit case for grant of anticipatory bail. The same is rejected. The petitioner is directed to surrender in the court below and seek regular bail in Sour Bazar P.S. Case no. 206 of 2013 pending in the court of C.J.M, Saharsa. The court below is directed to dispose of bail application of the petitioner on the same day without being prejudiced by the order of this Court.
