JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 03-09-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Sections 384, 386, 387 of the Indian Penal Code as well as under Sections 66(A), 66 (c) of the I.T. Act.

Allegation against the petitioner alongwith other accused persons is said to have demanded the extortion money from the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He further submits that there is no specific overt act against the petitioner. On the basis of confessional statement of co-accused, the petitioner has been made accused in this case.

The petitioner has 05 criminal antecedents which is mentioned in para 3 of the bail petition. Similar situated coaccused have been granted bail by different co-ordinate Benches of this Court.

Learned APP for the State vehemently opposed the prayer for bail petition.

I perused the record including the case diary, the petitioner has 05 criminal antecedents.

Considering the aforesaid facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected in connection with Masaurhi P.S. Case No. 373/2020 from the Court of learned S.D.J.M., Masaurhi at Patna. Accordingly, this application is dismissed.

However, the petitioner is at liberty to renew his prayer for bail after framing of the charge.
