The petitioner seeks anticipatory bail in connection with Kalyanpur P.S. Case No. 195 of 2017, registered for offences punishable under Sections 323, 324, 307 and 504 of the Indian Penal Code.
As per F.I.R., allegation against the petitioner is that he has taken rupees five hundred from the informant, when the informant demanded the same, he refused to give the same and assaulted with knife on the abdomen of the informant, causing injury.
Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and from the medical report, it appears that the injuries found on the person of the informant, is simple in nature (Annexure-2) and both the parties have compromised.
Patna High Court Cr.Misc. No.42782 of 2018(2) dt.24-07-2018 2/2 Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Kalyanpur P.S. Case No. 195 of 2017 to the satisfaction of learned A.C.J.M.- IX, Motihari, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
