The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 427 and 504/34 of the Indian Penal Code. The accusation is of assaulting the informant being a driver of Tata Magic vehicle and the passengers sitting therein of a marriage party. Co-accused Dhanik Lal Mandal was identified to have caused dagger injury. The petitioner and two others were apprehended by the passengers on the spot but subsequently they managed to escape. The apprehended accused disclosed their name. The petitioner was one of them.

No.2733 of 2015 (02) dt.21-01-2015 2/2 It is submitted by learned counsel for the petitioner that it appears unreasonable that the accused persons were apprehended and after disclosing their name they ran way from the place of occurrence. The accusation is not specific against them.

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Madhubani in connection with Benipatti P.S. Case No. 47 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
