The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 364, 120(B), 34 of the Indian Penal Code. Later on Section 302, 201 I.P.C was also added. It is alleged that son of the informant has been kidnapped and thereafter killed by the accused persons including the petitioner.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.61579 of 2021(3) dt.19-07-2022 2/3 petitioner that petitioner has falsely been implicated in this case. The petitioner was not named in the F.I.R. The name of the petitioner transpired in the confessional statement of Md. Chand with whom the petitioner was on inimical term from before. There is no eye witness of the occurrence and during investigation, the police did not find any material against the petitioner except confessional statement. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Sadar (Muffasil) P.S. Case No. 183 of 2021, subject to the conditions as laid down under
Patna High Court CR. MISC. No.61579 of 2021(3) dt.19-07-2022 3/3 Section 438(2) of the Cr.P.C.
