2. The following reliefs have been sought in the present writ petition:

"i For issuance of an order, direction or a writ of certiorari for quashing and setting aside the minutes of meeting of Tender Evaluation Committee dated 05.07.2025 as contained in Memo No. 2388 dated 07.07.2025 whereby and where under the aforesaid authority has inter alia rejected the technical bid of

Patna High Court CWJC No.11631 of 2025(7) dt.13-05-2026 2/3 the petitioner company against Notice Inviting Tender No. SBD-01/2024-25 published on 25.11.2024 in view of the fact that the petitioner has been declared defaulter and has been debarred from participating in subsequent tender vide Memo No. 2920 dated 27.06.2025 issued by the Water Resource Department.

ii. For issuance of an order, direction or a writ of mandamus for directing the respondent authorities to keep the aforesaid order contained in Memo No. 2388 dated 07.07.2025 to the extent to which it relates to disqualification of the petitioner, in abeyance during the pendency of the present writ application. iii. For issuance of an order, direction or an appropriate writ for directing the respondents to allow the petitioner to participate further in pursuance of tender arising from Notice Inviting Tender No. 01/2024-25 published on 25.11.2024 in Group No. 01, 02 and 03 and open his financial bid during the pendency of this writ petition.

Or/ alternatively iv. For issuance of an order, direction or an appropriate for staying the further process of Notice Inviting Tender No. 01/2024-25 dated 25.11.2024 by the office of Executive Engineer, Minor Irrigation Division, Kaimur, Mohania in so far as Group No. 01,02 and 03 works are concerned during the pendency of this writ application. "

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw the present writ petition.

4. Permission, as prayed for, is granted.

5. Accordingly, the present writ petition stands dismissed as withdrawn.
