JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-12-2014 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Wazirganj P.S.Case No. 102 of 2012 registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.
Petitioners are not named in the first information report and it appears from the submissions of the parties as well as impugned order that for the first time name of the petitioners appeared in this case in supervision note of the D.S.P and except the aforesaid material there appears to be nothing against them. Moreover, the F.I.R named accused namely, Roop Lal Yadav and Wazir Yadav had already granted anticipatory bail by a bench of this Court vide order dated 31.01.2014 passed in Cr. Misc. 41630 of 2013.
Patna High Court Cr.Misc. No.19033 of 2013 (3) dt.24-12-2014 2/2 Having regard to the facts and circumstances of the case, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Wazirganj P.S.Case No. 102 of 2012, subject to condition as laid down under Section 438(2) of the Cr.P.C.
