The petitioner has been in custody since 26.02.2018 in connection with Rajoun P.S. Case No. 489/2017 registered for the offences punishable under Sections 302/201/120(B)/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that though he is not named in the First Information Report, yet the entire story is concocted and the petitioner has no role to play. It is further submitted that only because the petitioner and one Banshidhar Rai together hired the Auto of the son of the deceased, there is no further material to indicate that the petitioner was, in fact, involved in the murder of the son of the informant. Patna High Court Cr.Misc. No.43061 of 2018 (3) dt.27-07-2018 2/2 further submitted that similarly situated co-accused person, namely, Buteli Mandal@ Uttam Kapri has since been extended the privilege of anticipatory bail in Cr. Misc. No. 10064 of 2018 vide order dated 20.02.2018.
In view of the fact that the petitioner and the said Buteli Mandal are similarly placed, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka, in connection with Rajoun P.S.
