SINGH ORAL ORDER 20-02-2025 In compliance of the order dated 04.02.2025, petitioner - Sajjan Kumar and O.P. No. 2 - Akarti Soni have appeared in the Chamber Proceedings with their respective lawyers.

2. The petitioner has filed the instant application for apprehending his arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

3. It is a case of matrimonial dispute between the petitioner and opposite party no. 2.

4. During course of argument, learned counsel for

Patna High Court CR. MISC. No.55771 of 2024(5) dt.20-02-2025 2/3 both the parties have tried their best for amicable settlement between the parties.

5. Both the parties agreed that petitioner - Sajjan Kumar being husband will pay a sum of Rs. 7,00,000/- (Seven Lakh) to the complainant - Aakriti Soni (wife of the petitioner) as full and final settlement.

Petitioner is directed to pay the entire amount i.e. Rs. 7,00,000/- (Seven Lakh) to the complainant in total 13 installments of which the first installment will be of Rs. 1,00,000/- (One Lakh) payable within one month from the date of receipt of copy of this order or at the time of filing of bail bond. So far as other 12 installments are concerned, each of Rs. 50,000/- (Fifty Thousand) will be paid by the 10th of every month.

7. As per mutual consent, both the parties are directed to withdraw the cases pending against each other.

8. Having heard learned counsel for the parties and considering the aforementioned facts, this Court is inclined to enlarge the petitioner on provisional bail. The above named petitioner is directed to be enlarged on provisional bail in connection with Complain Case No. 832 of 2020 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of

Patna High Court CR. MISC. No.55771 of 2024(5) dt.20-02-2025 3/3 the like amount each to the satisfaction of learned S.D.J.M. (East), Muzaffarpur, along with the receipt of payment of Rs. 1,00,000/- (One Lakh).

9. Trial Court is directed to confirm the provisional bail granted to the petitioner after verifying the deposit receipts of payment of the entire amount i.e. Rs. 7,00,000/- by the petitioner to the opposite party. Trial Court will also verify the withdrawal of pending cases between both the parties.

10. Accordingly, the instant application for anticipatory bail stands disposed of.
