Heard the learned counsel, Mr. Shambhu Sharan Singh, on behalf of the petitioner and the learned counsel, Mr. Dilip Kumar, on behalf of the plaintiff-respondent. 2.
By the impugned order dated 03.02.2014, the learned Sub Judge Ist, Patna City in Title Eviction Suit No.5 of 2013 directed the defendant petitioner to pay the arrears of rent of Rs.49,500/- within fifteen days and also directed to pay the current and future rent at the same rate. The relation of landlord and tenant is admitted by the defendant. The rate of rent is also admitted by the present petitioner. The only defence taken by the petitioner is that in fact the petitioner has not defalcated in payment of rent and he was regularly remitting the rent through money order to the plaintiff but the plaintiff was not receiving the same. 3.
In view of the above facts and circumstances of the case
Patna High Court CWJC No.5218 of 2014 (3) dt.14-12-2015 2/2 that the relationship and rate of rent is admitted, I find no reason to interfere in the impugned order and thus, this writ application is hereby dismissed.
