This is a petition for grant of regular bail in connection with Kahalgaon P.S. Case No. 337 of 2018 for offences under Sections 327, 409 and 420 of the Indian Penal Code and 40 of the Bihar Minor Mineral Concession Rules, 1972.
Allegation, in brief, is that the petitioner, a truck driver was found carrying over loaded stone chips in the truck and it is alleged that one Lalo Mandal in connivance with this petitioner used to manage after taking illegal gratification allowing the over loaded trucks to pass through the check post. Learned counsel for the petitioner submits that the petitioner, the truck driver is not indulged in such nefarious

No.46940 of 2018(2) dt.01-08-2018 2/2 activities of getting over loaded trucks passed at the check post rather the petitioner was apprehended with over loaded stone chips, except that there is no other material against him and the petitioner has been in custody for last two months and he has no criminal antecedent.
Having considered the aforesaid facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Kahalgaon P.S.
