JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-09-2022 Heard learned counsel for the petitioners and the State. Nobody appeared for opposite party no.2 inspite of valid service of notice to him.

Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341, 323, 448, 498A, 504, 506/34 of the Indian Penal Code.

Daughter of opposite party no.2 is a divorcee and petitioner no. 1 is husband, petitioner no. 2 is father-in-law, petitioner nos. 3 and 4 are brothers-in-law (dewar) and

Patna High Court CR. MISC. No.61334 of 2021(4) dt.05-09-2022 2/2 petitioner no. 5 is mother-in-law of the victim. It is alleged that the petitioners entered into the house of the informant and assaulted him and his daughter. Petitioners took her signature on papers and they threatened her and told not to return the cash and articles given to them at the time of marriage. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. They submit that they are still ready to keep the victim at her matrimonial house with honour and safety. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.

10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate II, Bhagalpur in Akbar Nagar Police Station Case No. 09 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
