The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.

Accusation is of kidnapping the minor sister of the informant.

It is submitted by the learned counsel for the petitioner that in the statement under Section 164 Cr.P.C. the victim got her age recorded as 20 years where she has stated that she married with the petitioner and gave birth of a child also. Victim has been released in favour of grand father of the petitioner. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent Considering the aforesaid facts, let the above

Case No. 456 of 2012, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
