JUSTICE SANJAY PRIYA ORAL ORDER 5/ 24-07-2018 Heard learned counsel for the petitioner and learned APP for the State as well as learned counsel for the Informant. Petitioner apprehends his arrest in Rupaspur P.S. Case No.427 of 2017 instituted for the offence under Section(s) 406, 420/34 Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

In the written report, it is alleged that marriage of daughter of the informant was fixed with this petitioner. It is further alleged that informant has made expenses of Rs.2,90,000/- in the engagement ceremony but later on demand of four wheeler was made in the marriage due to which marriage of petitioner with daughter of the informant could not be performed.

Patna High Court Cr.Misc. No.31254 of 2018 (5) dt.24-07-2018 2/3 Counsel for the petitioner has pointed out that in the written report itself the informant has stated that he is not inclined to perform marriage of his daughter with this petitioner. It is further submitted that the case has been filed by the informant only to put pressure to get some money from the petitioner as mentioned in the written report. In the facts and circumstances of the case, prayer of the petitioner for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Rupaspur P.S. Case No.427 of 2017, he shall be released on anticipatory bail on furnishing bail bond of Rs.

10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Danapur, Patna, subject to the conditions as laid down under Section 438(2) Cr. P. C.

Patna High Court Cr.Misc. No.31254 of 2018 (5) dt.24-07-2018 3/3 prosecution will be at liberty to move for cancellation of bail of the petitioner.
